At the SCD we encourage ditch users to apply for a multi-year 310 Maintenance Permits to remove debris from your headgate. This page is to help avoid any confusion on what exactly you need to do with the SCD and other permitting agencies to keep your ditch in compliance. How do I apply for a Maintenance permit?

Just click the page icon and it will take you to our applications page. You need to fill out the entire joint application including marking the "applying for a maintenance permit" box and also fill out and submit the annual maintenance plan form.

Working Together

What do I need to do each year?

You need permits from the SCD (310), FWP (318), USACE, and Floodplain to be compliant. The only permit that you are awarded for multiple years is the 310 permit from the SCD. Each of the other agencies may require you to apply every year. The SCD can not speak for the other agencies and you must contact them to be sure you are in compliance with their current regulations. There's no cost to get a permit or ask a question to stay in compliance, but there can be significant costs associated with violations if you neglect to get the proper permits.

You MUST renew this permit each year.

Just send a quick email referencing your permit #, Project/Ditch Name, the stream it's on and when you'll be doing the work to:

USACE Paragraph

Section 404/Section 10 Permit - USACE

You can send in the same joint application that you used last year, just update the dates. These go to a general email and the phone number is a mainline. Please call them to confirm if you do have an exemption or ask any other questions.

Before you do work allowed by your

Please give the SCD a call at 406-322-5359 ext 101 or send an email to stillwaterconservationdistrict@gmail.com to let us know you will be working in the stream and how long you think the project will take. This just helps us to know what is going on so if a passer-by calls to alert us that there is work being done in the stream we know it's permitted.
